{"id":58787,"date":"2020-06-20T17:31:38","date_gmt":"2020-06-20T17:31:38","guid":{"rendered":""},"modified":"2020-06-20T17:31:38","modified_gmt":"2020-06-20T17:31:38","slug":"graciana-penafort-afirmo-que-el-fallo-del-juez-lorenzini-sobre-vicentin-no-tiene-fundamentos","status":"publish","type":"post","link":"https:\/\/primereando.com.ar\/index.php\/2020\/06\/20\/graciana-penafort-afirmo-que-el-fallo-del-juez-lorenzini-sobre-vicentin-no-tiene-fundamentos\/58787\/","title":{"rendered":"Graciana Pe\u00f1afort afirm\u00f3 que el fallo del juez Lorenzini sobre Vicentin no tiene fundamentos"},"content":{"rendered":"<p>La directora de Asuntos Jur&iacute;dicos del Senado de la Naci&oacute;n,&nbsp;Graciana Pe&ntilde;afort,&nbsp;analiz&oacute; el fallo que frena la intervenci&oacute;n a Vincentin:&nbsp;&quot;El fallo que anula la intervenci&oacute;n de Vicent&iacute;n no tiene fundamentos, es arbitrario&quot;.&quot;El fallo no cita ninguna norma porque lo existe una norma para hacer lo que hizo el juez&quot;, consider&oacute;.<\/p>\n<p>En di&aacute;logo radial, Pe&ntilde;afort explic&oacute; que&nbsp;el juez Lorenzini &quot;dijo que no pod&iacute;a declarar la inconstitucionalidad del decreto pero luego hace un absurdo jur&iacute;dico&quot; y que&nbsp;&quot;si no declara inconstitucional el decreto de Alberto Fern&aacute;ndez es un decreto v&aacute;lido pero el juez llama a no cumplirlo&quot;.<\/p>\n<p>&quot;El juez Lorenzini hace de cuenta que es presidente&quot;, afirm&oacute; la abogada y agreg&oacute;: &quot;Dice que los interventores ya no lo son sino que son veedores&quot;.&nbsp;&quot;El juez Lorenzini puede declarar inconstitucional un decreto pero no modificarlo, eso es ilegal:&nbsp;ordena desobedecer un decreto al que dice que no puede declarar inconstitucional&quot;,&nbsp;expres&oacute;.<\/p>\n<p>Pe&ntilde;afort ense&ntilde;&oacute; qu&eacute; debe suceder a partir de la decisi&oacute;n de Lorenzini:&nbsp;&quot;Lo primero que deber&iacute;a pasar es que el Estado apele la medida del juez Lorenzini.&nbsp;Corresponder&iacute;a apelar y dar la pelea judicial&quot;. &quot;El precedente judicial de inventar el derecho no puede pasar&quot;, exclam&oacute; la abogada y dijo que&nbsp;no conoce ning&uacute;n concurso de acreedores que haya funcionado con los niveles de endeudamiento que tiene Vicent&iacute;n.<\/p>\n<p>En este sentido, cont&oacute; que&nbsp; &quot;el concurso de acreedores se cre&oacute; para que la empresa pueda pagar, pero ni Correo Argentino ni Vicentin quieren pagar&quot;.&nbsp;&quot;Vicent&iacute;n no les hizo ninguna propuesta a los acreedores, no muestra que quiera pagar&quot;, afirm&oacute; Pe&ntilde;afort y dijo que&nbsp;&nbsp;&quot;la primera condici&oacute;n que puso el CEO de Vicent&iacute;n, Nardelli, era que no le hicieran demandas.
