El ex delantero de la Selecci\u00f3n Argentina hab\u00eda iniciado maniobras judiciales para no pagar el Aporte Solidario y Extraordinario de las Grandes Fortunas, aprobado por el Congreso para paliar los efectos de la pandemia <\/h2>\n\n\n\n

La Justicia Federal de Reconquista orden\u00f3 un embargo por m\u00e1s de 71 millones de pesos al exfutbolista y productor agropecuario Gabriel Batistuta<\/strong>, luego de una demanda de la Administraci\u00f3n Federal de Ingresos P\u00fablicos (AFIP) por incumplimientos en el pago del Aporte Solidario y Extraordinario de las Grandes Fortunas, aprobado por el Congreso para paliar los efectos de la pandemia de coronavirus.<\/strong><\/p>\n\n\n\n

La resoluci\u00f3n estuvo a cargo del juez federal de Reconquista, Aldo Alurralde, quien orden\u00f3 el embargo el 17 de agosto sobre tres inmuebles del exintegrante del seleccionado argentino.<\/p>\n\n\n\n

Seg\u00fan informa este domingo el portal ReconquistaSF, el embargo es por 71.096.882,09 <\/strong>pesos, de los cuales 46.059.135,85 pesos son en concepto de capital y los restantes 25.037.746,24 pesos por intereses.<\/p>\n\n\n\n

En mayo, Alurralde hab\u00eda rechazado una medida cautelar presentada por el exfutbolista de Boca Juniors, River Plate y Fiorentina de Italia, entre otros equipos, para no pagar el tributo tambi\u00e9n conocido como Impuesto a la Riqueza, por lo que el caso pas\u00f3 a a C\u00e1mara Federal de Apelaciones de Resistencia.<\/p>\n\n\n\n

El Tribunal de Alzada de la capital chaque\u00f1a, integrado por las juezas Mar\u00eda Denogens, Roc\u00edo Alcal\u00e1 y Patricia Garc\u00eda, le dio la raz\u00f3n a Alurralde el 29 de junio pasado al desestimar el recurso presentado por Batistuta.<\/p>\n\n\n\n

El exfutbolista present\u00f3 originalmente la medida cautelar ante el fuero en lo Contencioso Administrativo n\u00famero 4 de la Ciudad Aut\u00f3noma de Buenos Aires, que se declar\u00f3 incompetente y la remiti\u00f3 a Reconquista, de donde es oriundo y en cuya zona posee unas 126 mil hect\u00e1reas de campo.<\/p>\n\n\n\n

Batistuta consider\u00f3 que el aporte solidario \u201cvulnera derechos, principios y garant\u00edas constitucionales <\/strong>y en especial el derecho de propiedad y la garant\u00eda de no confiscatoriedad\u201d, por lo que viola \u201cla garant\u00eda constitucional de igualdad frente a los impuestos y las cargas p\u00fablicas\u201d.<\/p>\n\n\n\n

Pero en su fallo, las juezas Denogens, Alcal\u00e1 y Garc\u00eda consideraron que “no se advierten configurados los requisitos exigibles para la procedencia de la medida cautelar pretendida, resultando ello suficiente para desestimar el recurso incoado por el requirente y confirmar la decisi\u00f3n del juez de la anterior instancia”.<\/p>\n","protected":false},"excerpt":{"rendered":"
