Esta medida permitir\u00e1 desestimar todas las acciones iniciadas contra la petrolera argentina y contra Repsol. <\/h2>\n\n\n\n

YPF\u00a0<\/strong>anunci\u00f3 que alcanz\u00f3 un acuerdo por el\u00a0caso Maxus en Estados Unidos,<\/strong>\u00a0lo que permitir\u00e1 desestimar todas las acciones iniciadas contra la petrolera argentina y contra Repsol y otorgar\u00e1 una liberaci\u00f3n y absoluci\u00f3n total de los reclamos que present\u00f3 en su momento el Fideicomiso de Liquidaci\u00f3n de Maxus por hasta US$ 14.000 millones.<\/p>\n\n\n\n

En un comunicado, la petrolera argentina record\u00f3 que tras la privatizaci\u00f3n en 1992 de YPF, la compa\u00f1\u00eda despleg\u00f3 una estrategia de expansi\u00f3n internacional en la adquiri\u00f3 Maxus<\/strong>, una empresa estadounidense de petr\u00f3leo y gas. Por entonces esta firma contaba con activos en diversos pa\u00edses del mundo (Estados Unidos, Bolivia, Indonesia, Ecuador y Venezuela), lo que para YPF \u2013controlada por Repsol- signific\u00f3 el puntapi\u00e9 de una estrategia de negocios que a la luz de la \u00e9poca se presentaba como atractiva.<\/p>\n\n\n\n

A\u00f1os antes, en 1986, Maxus hab\u00eda vendido su negocio de qu\u00edmicos a Occidental Chemical Corporation y aceptado indemnizar a la misma por los pasivos ambientales derivados de sus operaciones.<\/p>\n\n\n\n

Posteriormente, en el a\u00f1o 2005 el Estado de Nueva Jersey demand\u00f3 a Occidental y a Maxus -a\u00f1adiendo m\u00e1s tarde a YPF y Repsol- por la contaminaci\u00f3n del r\u00edo Passaic -a 10 kil\u00f3metros de la ciudad de Nueva York- con residuos qu\u00edmicos.<\/p>\n\n\n\n

Occidental hizo valer su indemnidad y Maxus, la empresa que hab\u00eda adquirido YPF en 1995, honr\u00f3 sus obligaciones hasta que el 17 de junio de 2016 tom\u00f3 la decisi\u00f3n de presentarse en concurso y posteriormente se decret\u00f3 su quiebra.<\/p>\n\n\n\n

En junio de 2018 el Fideicomiso de Liquidaci\u00f3n de Maxus demand\u00f3 a YPF y Repsol y ciertas subsidiarias, por un monto de hasta 14.000 millones de d\u00f3lares ante el Tribunal de Quiebras del Distrito de Delaware. El Fideicomiso aleg\u00f3 que Maxus tuvo la intenci\u00f3n de obstaculizar, retrasar o defraudar a sus acreedores.<\/p>\n\n\n\n

El acuerdo alcanzado por YPF<\/h2>\n\n\n\n

En un comunicado, YPF<\/strong> inform\u00f3 esta noche que tras a\u00f1os de litigio y negociaciones el Fideicomiso de Liquidaci\u00f3n de Maxus y luego de obtener de parte de la petrolera argentina, en junio de 2002, una decisi\u00f3n de juicio sumario parcial por parte del Tribunal de Quiebras, YPF y Repsol llegaron a un acuerdo de conciliaci\u00f3n.<\/p>\n\n\n\n

Ese acuerdo determina que el Fideicomiso de Liquidaci\u00f3n de Maxus desistir\u00eda de las reclamaciones que ha presentado contra YPF<\/strong> y Repsol en el Tribunal de Quiebras del Distrito de Delaware, as\u00ed como a todas las reclamaciones actuales y futuras que puedan tener contra ambas compa\u00f1\u00edas.<\/p>\n\n\n\n

A cambio de esto, YPF<\/strong> y Repsol se comprometieron a pagar al Fideicomiso un monto de US$ 287,5 millones cada uno, lo que hace una cifra total de US$ 575 millones. El monto que deber\u00e1 abonar YPF equivale s\u00f3lo al 2% de la cifra original de la demanda.<\/p>\n\n\n\n

El acuerdo est\u00e1 sujeto a aprobaci\u00f3n judicial y otras condiciones que deber\u00e1n cumplirse a lo largo de los pr\u00f3ximos meses, detall\u00f3 el comunicado de YPF<\/strong>.<\/p>\n\n\n\n

Asimismo, YPF<\/strong> y Repsol firmaron tambi\u00e9n un acuerdo transaccional con Occidental Chemical Corporation y algunas de sus afiliadas, bajo el que Occidental acord\u00f3 renunciar a reclamos futuros que pueda tener contra ambas compa\u00f1\u00edas en relaci\u00f3n con las entidades Maxus, el r\u00edo Passaic y otras \u00e1reas sujetas a remediaci\u00f3n ambiental.<\/p>\n\n\n\n

En esta l\u00ednea, tanto YPF<\/strong> como Repsol tambi\u00e9n firmaron entendimientos con varias entidades gubernamentales, incluidos el Departamento de Justicia actuando en representaci\u00f3n de la Agencia de Protecci\u00f3n Ambiental de EEUU, y los Estados de Ohio y de Wisconsin, bajo el que las entidades gubernamentales se han comprometido a no presentar reclamos contra ambas empresas en cuestiones similares a las registradas con anterioridad en el marco del Fideicomiso de Liquidaci\u00f3n de Maxus.<\/p>\n\n\n\n

Los acuerdos con Occidental y la Agencia de Protecci\u00f3n Ambiental de EEUU se encuentra similarmente sujeto a ciertas condiciones precedentes.<\/p>\n\n\n\n

\u201cDe cumplirse las condiciones, los acuerdos dar\u00e1n por terminado el litigio que se extendi\u00f3 durante a\u00f1os, llegando a un cierre justo y razonable para todas las partes, y que permitir\u00e1 a YPF seguir centrando sus esfuerzos en la generaci\u00f3n de valor y empleo, profundizar el crecimiento de su producci\u00f3n y enfocar sus esfuerzos en las inversiones necesarias para robustecer y diversificar la matriz energ\u00e9tica argentina\u201d, sostuvo la empresa que conduce Pablo Gonz\u00e1lez.<\/p>\n","protected":false},"excerpt":{"rendered":"
